Abstract

The legal formulations approved by the constitutional legislator to register a socioeconomic field give legitimacy to state actions to promote development. These legal formulations allow for a more in-depth reflection on the policies and actions that allow the conformity of reality to the constitutional norms that prescribe development as a means and objective to be achieved by the performance of the State. In this perspective, the importance of understanding legal principles is affirmed, notably in the economy of the constitution, as it is seen in the application of legal rules the need for their adequacy to guide an economic order from the fundamental precepts for the well-being of the person human, compliance with the objectives of the Constitutional Charter of 1988, and thus, this adequacy comes to figure as a primordial factor for the achievement of society's objectives. In this context, the protagonism of the constitutional text is adopted through a theoretical-hermeneutic approach towards the realization of social and economic rights and guarantees, always taking into account the realization of the dignity of the human person and social justice.
