Abstract

This article analyzes the evolution of Brazilian electoral jurisprudence in combating candidacies linked to criminal organizations, focusing on militias in Rio de Janeiro, specifically in the Baixada Fluminense region. The research employs a qualitative methodology based on documentary analysis of decisions from the Regional Electoral Court of Rio de Janeiro (TRE-RJ) and the Superior Electoral Court (TSE), combined with specialized bibliographic review. The results demonstrate significant jurisprudential evolution in the application of Article 14, §9, and Article 17, §4 of the Federal Constitution, showing a more proactive interpretation in protecting the electoral process. The analysis of precedents reveals a trend toward strengthening preventive control mechanisms for candidacies, prioritizing the protection of election normality and legitimacy. The study concludes that, although there have been significant advances in combating organized crime's infiltration into the electoral process, challenges persist that require improving legislation and strengthening institutional cooperation between control and oversight bodies.

Fernando Vinicius Souza Rodrigues, TRIBUNAL REGIONAL ELEITORAL DE MATO GROSSO

Holder of a degree in Accounting from the Federal Rural University of Rio de Janeiro (UFRRJ), with specializations in Public Management from the Federal Institute of Mato Grosso (IFMT) and in Electoral Law from the Pontifical Catholic University of Minas Gerais (PUC Minas). Completed advanced courses in Diversity and Inclusion from the National Institute for Educational Studies and Research Anísio Teixeira (INEP) and Human Rights from the Superior School of the Public Ministry of the Union (ESMPU), as well as several other advanced and complementary trainings in areas such as Public Management, Humanized Leadership, Interpersonal Relations, Emotional Intelligence, and Electoral Law. Since 2016, has served as a Federal Effective Employee at the Regional Electoral Court of Mato Grosso (TRE-MT), and in 2020, assumed the position of Head of the Electoral Court of the 31st Electoral Zone in Canarana-MT. Develops work in the areas of Democracy, Electoral Law, Indigenous Inclusion, and Diversity.
